Terms Defined:
  • Redemption Period: The amount of time that a homeowner has to purchase (redeem) their property back after being sold at public auction.
  • Judicial: A foreclosure that requires a court action. The lender must file a lawsuit against the borrower to obtain a court order to foreclose.
  • Non-Judicial: This process of foreclosure can be used when a power of sale clause exists where the borrower has authorized the sale of the property in the event of their default. This type of foreclosure is done by advertisement.
  • Deficiency Judgement: A personal judgment against the borrower for any remaining balance on the loan after a foreclosure sale.
